In a Joint Meeting of Bar Council of India and the State Bar Councils and the Coordination Committee of All District Court Bar Associations of Delhi, SCBA, DHCBA, STBA, CATBA, DRTBA, TBA, AFTBA and other Bar Associations of Delhi-NCR, held on 02.02.2019, it has been decided to hold a nationwide protest march on 12.02.2019 at all State and District Headquarters, wherein the State Bar Councils and Bar Associations will stage a Protest March.

The said Protest against the Union Government is being made to press for various demands, as the Union Government has done nothing for the legal fraternity despite the fact that the advocates are the pillars of democratic fabric of the country. The demands raised in the Joint Meeting are namely, (i) Medical facility, (2) Insurance (3) Housing Schemes, (4) Financial Assistance (Stipend) to the young lawyers (5) Pension Schemes, (6) Advocate Protection Act (7) Not to scrap Bar Council of India and State Bar Councils like Medical Council of India, (8) To amend the Legal Services Authority Act, to enable the lawyers to discharge the functions under the Act, (9) To amend all the Acts providing for appointment of Retired Judges/Judicial Officers as Presiding Officers in various Tribunals and Commissions etc.

Pursuant to the said decision, the office bearers of Bar Council of India, Bar Council of Delhi and the Coordination Committee of All District Court Bar Associations of Delhi and NCR, SCBA, DHCBA, STBA, CATBA, DRTBA, TBA, AFTBA and other Bar Associations of Delhi-NCR will hold the Peaceful Protest March from Patiala House Court at 12.30 PM (Assembly at 12.00 Noon) and proceed to Jantar Mantar.

The Protest March will start from Patiala House Court at 12.30 PM and will culminate at Jantar Mantar and the procession will go through Tilak Marg, Bhagwan Dass Road, Mandi House, Barakhamba Road, Tolstoy Marg, Jantar Mantar.

This is for the first time that the lawyers have come out to protest against the Government as Union Government has not come out with any budgetary provisions for the benefit of the lawyers, though some State Governments at their own have come out with different welfare schemes such as medical, housing, stipend for young lawyers etc. and similarly some other states have come out with budgetary provisions with a good one time corpus with budgetary provisions on yearly basis for advocates welfare, however, those schemes are restricted to only some of the States and are not being made applicable to the legal fraternity in large.

It is, under these circumstances, the legal fraternity is urging upon the Union Government to provide budgetary allocation at all India level to ensure that the welfare scheme for lawyers as stated above may be implemented uniformly at national level.

The legal community throughout the country has joined together in this movement for enforcement of their legitimate rights and fulfilment of the demands raised herein-above amongst others.

Clarification regarding Vakalatnama by the advocates

It is clarified that law firms are not competent and authorized to file
Vakalatnama before any Court, Tribunal, Authority, in Arbitration or any other proceedings, and if any such Vakalatnama is filed by a law firm, the same should not be entertained or accepted.

It is further clarified that every Vakalatnama has to be duly signed by an
Advocate, mentioning his/her name, along with enrolment number, and must be affixed with the welfare stamp of requisite value as being mandatory without which the Vakalatnama cannot be accepted.
